By accessing or using KCVoIP services ("Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the Services, including customers, administrators, and end users.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of Services

KCVoIP provides Voice over Internet Protocol (VoIP) communication services including:

• Voice calling services (local, long-distance, international)
• Phone number provisioning and management
• Voicemail and messaging services
• Conference calling and collaboration tools
• Mobile and desktop applications
• Hardware sales and installation services
• Technical support and maintenance

3. Account Registration and Security

Account Creation

To use our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Using strong passwords and enabling multi-factor authentication

4. Acceptable Use Policy

Permitted Uses

You may use our Services for legitimate business and personal communications in compliance with applicable laws and regulations.

Prohibited Uses

You may not use our Services for:

• Illegal activities or violation of any laws or regulations
• Harassment, abuse, or threatening communications
• Spam, unsolicited commercial communications, or telemarketing
• Fraud, including toll fraud or premium rate service fraud
• Circumventing security measures or unauthorized access attempts
• Interfering with the Services or other users' use of the Services
• Transmitting malware, viruses, or other harmful code

5. Service Plans and Billing

Service Plans

We offer various service plans with different features and pricing. Plan details are available on our website and may be modified with advance notice.

Billing and Payment

• Services are billed monthly in advance
• Usage-based charges are billed monthly in arrears
• Payments are due within 30 days of invoice date
• Late payments may result in service suspension
• We accept major credit cards and ACH payments

Pricing Changes

We may change our pricing with 30 days' written notice. Continued use of Services after a price change constitutes acceptance of the new pricing.

6. Service Availability and Performance

Service Level Commitment

We strive to maintain high service availability but do not guarantee uninterrupted service. Our target uptime is 99.9% for paid services.

Maintenance and Upgrades

We may perform scheduled maintenance that temporarily affects service availability. We will provide advance notice when possible.

Emergency Services Limitations

Important: VoIP services have limitations for emergency (911) calling:

• Emergency services depend on internet connectivity and power
• Location information may not be automatically transmitted
• Service may not function during power or internet outages
• You should maintain alternative means for emergency communications

7. Data and Privacy

Your privacy is important to us. Our data handling practices are governed by our Privacy Policy, which is incorporated by reference into these Terms.

Call Records

We maintain call detail records (CDRs) as required by law and for billing purposes. We do not record or store the content of your voice communications without your explicit consent.

8. Intellectual Property

Our Rights

KCVoIP and related marks, logos, and content are owned by KCSuper.tech. You may not use our intellectual property without written permission.

Your Rights

You retain ownership of your content and data. By using our Services, you grant us a limited license to process your data as necessary to provide the Services.

9. Termination

Termination by You

You may terminate your account at any time with 30 days' written notice. You remain responsible for all charges incurred up to the termination date.

Termination by Us

We may terminate or suspend your account:

• For violation of these Terms
• For non-payment of fees
• For illegal or harmful use of Services
• If required by law or regulation

Effect of Termination

Upon termination:

• Your access to Services will cease
• We may delete your data after 30 days
• You remain liable for outstanding charges
• Provisions regarding liability and indemnification survive

10. Liability and Warranties

Service Warranty

We provide Services on an "as is" basis. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to:

• Direct damages only (no consequential or indirect damages)
• Amount paid by you in the 12 months preceding the claim
• Service credits for verified outages as our sole remedy

Indemnification

You agree to indemnify and hold harmless KCSuper.tech from claims arising from your use of Services, violation of these Terms, or violation of any third-party rights.

11. Dispute Resolution

Governing Law

These Terms are governed by Missouri state law and federal law, without regard to conflict of law principles.

Jurisdiction

Any disputes will be resolved in the state or federal courts located in Kansas City, Missouri.

Arbitration

For disputes under $10,000, you may choose binding arbitration through the American Arbitration Association instead of court proceedings.

12. Regulatory Compliance

FCC Compliance

Our Services comply with Federal Communications Commission regulations including:

• Customer Proprietary Network Information (CPNI) protection
• Emergency services (E911) requirements
• Telecommunications Relay Service (TRS) accessibility
• Robocall and spam prevention

State and Local Compliance

You are responsible for compliance with applicable state and local regulations, including:

• Sales tax obligations
• Professional licensing requirements
• Industry-specific regulations (healthcare, finance, etc.)

13. Hardware and Equipment

Hardware Sales

Hardware purchases are subject to separate warranty terms provided by manufacturers. We provide installation and configuration services as specified in your service agreement.

Customer Equipment

You are responsible for maintaining your internet connection, network equipment, and any customer-owned devices used with our Services.

14. International Services

International calling rates apply to calls outside the United States and Canada. Rates are subject to change and will be posted on our website.

You are responsible for compliance with laws in destination countries and may be restricted from calling certain destinations.

15. Modifications to Terms

We may modify these Terms at any time by:

• Posting updated Terms on our website
• Sending notice to your registered email address
• Providing notice in your account dashboard

Material changes will be effective 30 days after notice. Continued use of Services constitutes acceptance of modified Terms.

16. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and KCSuper.tech.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, government actions, or infrastructure failures.
